SUBSTITUTED TRUSTEE'S NOTICE OF SALE

WHEREAS, on June 17, 2013,Primis Wheeler, Jr. and Earlene J. Wheeler executed and delivered a deed of trust to Charles N. Parrot, Trustee for the use and benefit of Regions Bank dated June 17, 2013,  which deed of trust was filed for record on June 24, 2013, in Book 2013 at Page 626 and re-recorded on October 30, 2013 in Book 2013 at Page 1324 of the records on file in the office of the Clerk of the Chancery Court of the Second Judicial District of Tallahatchie County, Mississippi; and

WHEREAS, Regions Bank has heretofore substituted Jay Gore, III, in the above referenced Deeds of Trust as Trustee by instrument dated December 13, 2016, filed December 20, 2016, and recorded in Book 2 at page 282 of the records on file in the office of the Clerk of the Chancery Court of the Second Judicial District of Tallahatchie County, Mississippi; and,

WHEREAS, default has been made and still continues in the payment of said indebtedness, as and when due, and the undersigned Substitute Trustee has been called upon by Regions Bank, the owner and holder of the indebtedness, to foreclose and sell the property covered by said deeds of trust.  Therefore, in accordance with the provisions, the beneficiary thereof has exercised the option in such case provided and has declared the entire unpaid balance of said indebtedness immediately due and payable.  The beneficiary has directed the undersigned Substitute Trustee to execute the same by sale of the property therein described in accordance with the terms and provisions of the deed of trust for the purpose of raising the sum so secured and unpaid, together with the expense of selling the same, including Trustee's and attorney's fees.

LOITERING ORDINANCE

Before the Mayor and Board of Aldermen of the Town of Webb, Mississippi:

Whereas, it has been brought before the Board that a loitering ordinance be issued to promote the safety and welfare of the Town of Webb.

NOW THEREFORE, BE IT ORDAINED, by the Town of Webb that:

No person shall remain on a public street, sidewalk or pathway, including one privately owned but generally used by the public, as not to obstruct the free passage of pedestrians and/or motor vehicles after a sworn law enforcement officer has verbally informed the person that such action is unlawful and has requested the person to move from that place;

No person shall remain in or on a motor vehicle on a public street or sidewalk or pathway, including one privately owned but generally used by the public, as not to obstruct the free passage of pedestrians and/or motor vehicles after a sworn law enforcement officer has verbally informed the person that such action is unlawful and has requested the person to move from that place;

It shall be unlawful for any person to refuse or fail to leave a private business or commercial establishment that is open for business, or a parking lot of the private business or commercial establishment, after having been verbally requested to do so by the owner, the owner's agent or a sworn law enforcement officer;

It shall be unlawful for any person to refuse or fail to leave a public building, public grounds, or a public recreational area, after being verbally requested to do so by a sworn law enforcement office or a guard, watchman, or other authorized employee of the agency or institution responsible for the security of the public building, public grounds, recreational area or parking lot, under circumstances that indicate that the person has no apparent lawful business or purpose to pursue in that place;

Any person violating any provision of this article shall be deemed guilty of a misdemeanor and shall be punished by a fine of not less than Twenty-Five dollars ($25.00) not more than Five-Hundred dollars ($500.00) or imprisonment in the county jail not to exceed ninety (90) days, or both.  Each day's violation shall be deemed a separate offense.

This ordinance was passed by the unanimous vote of Board of Aldermen of the Town of Webb, this the 3rd day of January 2017.

On or after February 2, 2017, the Town of Tutwiler will submit a request to the Mississippi Development Authority for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project:

Project Title: Town of Tutwiler Sewer Improvements

Purpose: Rehabilitation of the sewage treatment plant and sewage collection system.

Location: Town wide & sewage treatment station

Estimated Cost: $450,000

The activities proposed comprise a project for which a Finding of No Significant Impact on the environment was published on February 2, 2017. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Town of Tutwiler Town Hall; 201 Laura Street; Post Office Box 176; Tutwiler, MS 38963 and North Delta Planning & Development District; 220 Power Drive; Batesville, MS 38606 and may be examined or copied weekdays 9 A.M to 4 P.M.

FINDING OF NO SIGNIFICANT IMPACT

The Town of Tutwiler has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Town of Tutwiler. All comments received by February 10, 2017, will be considered by the Town of Tutwiler prior to submission of a request for release of funds.

RELEASE OF FUNDS

The Town of Tutwiler certifies to Mississippi Development Authority that Nichole Harris in her capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Mississippi Development Authority's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Tutwiler to use HUD program funds.

OBJECTIONS TO RELEASE OF FUNDS

The Mississippi Development Authority will accept objections to its release of fund and the Town of Tutwiler's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Tutwiler; (b) the town has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by Mississippi Development Authority; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Attention: Shirley Thompson at Mississippi Development Authority, Community Services Division, Post Office Box 849, Jackson, Mississippi,39205-0849. Potential objectors should contact The Mississippi Development Authority to verify the actual last day of the objection period.
